Welcome to the Owen Hayes Motorsport (“OHM”) online shop. By purchasing through our website, you acknowledge and agree to the following Terms and Conditions. These terms apply to all orders placed via www.owenhayesmotorsport.com.
1. Scope of Application
These Terms govern the sale of products offered by Owen Hayes Motorsport through this website. By placing an order, you confirm that you are at least 18 years of age and legally capable of entering into binding contracts.
2. Product Use & Responsibility
All products sold by OHM are intended for professional motorsport and competition use. They may not be legal for use on public roads. It is the customer’s responsibility to ensure products are used in compliance with all applicable laws, regulations, and sanctioning body rules. OHM is not responsible for misuse, improper installation, or damages resulting therefrom.
3. Orders & Acceptance
Placing an order constitutes an offer to purchase. All orders are subject to acceptance and availability. OHM reserves the right to refuse, cancel, or limit quantities of any order at its sole discretion, including in cases of suspected fraud, product unavailability, or pricing errors.
4. Pricing & Taxes
All prices are listed in U.S. Dollars. Applicable state sales tax will be charged for orders shipped to:
California, Florida, Georgia, North Carolina, Ohio, Tennessee, Virginia
Prices are subject to change without notice. In the event of a pricing error, OHM reserves the right to cancel the order prior to shipment.
5. Payment Terms
We accept Visa, Mastercard, American Express, Google Pay, and Link. Payment is due at the time of purchase. For fraud prevention, OHM may request additional identification for large orders, mismatched billing/shipping addresses, or other flagged transactions. Orders will not ship until payment is fully authorized.
6. Shipping & Delivery
Shipping Region: We currently ship within the United States only.
Carrier: All orders ship via UPS. Available options and rates are shown at checkout.
Processing Time: Orders placed before 12:00 p.m. Pacific Time, Monday through Friday, are processed within 3 business days. Orders placed on weekends or holidays are processed the next business day.
Delivery Time: Delivery times depend on the selected UPS service. Delays caused by carriers, weather, or other unforeseen circumstances are outside of OHM’s control.
Risk of loss transfers to the customer once the package is delivered to the carrier.
7. Order Confirmation & Tracking
You will receive an order confirmation email immediately after purchase.
Once shipped, a shipping confirmation email with a tracking number will be provided.
Please retain your confirmation email, as it will be required for returns or exchanges.
8. Returns & Refunds
We want you to be satisfied with your order. Returns are accepted within 30 days of the original shipment date.
Return Process:
Email returns@owenhayesmotorsport.com to request authorization.
Return the item(s) in new, unused condition with:
A copy of your order confirmation email
A photo of the packing slip included in your package
Ship prepaid via a trackable method. Customers are responsible for all return shipping costs.
Refunds & Exchanges:
Original shipping/handling fees are non-refundable.
Refunds will be credited to the original payment method only.
Exchanges will be shipped after the returned item is received and inspected. Customers are responsible for reshipping costs.
OHM reserves the right to refuse returns that do not meet the conditions above.
9. Warranty Disclaimer
Unless otherwise stated in writing, products are sold “as is” without warranty of any kind. OHM expressly disclaims all implied warranties, including but not limited to merchantability or fitness for a particular purpose.
10. Limitation of Liability
To the maximum extent permitted by law, OHM shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of profits, arising out of the purchase, use, or inability to use products.
11. Intellectual Property
All website content—including text, graphics, photos, logos, and design elements—is the property of Owen Hayes Motorsport unless otherwise credited, and is protected under U.S. and international copyright laws. Unauthorized use is prohibited.
12. Governing Law & Jurisdiction
These Terms and any disputes arising hereunder shall be governed by the laws of the State of California, without regard to conflict of law principles. Any legal proceedings shall be brought in the courts located in Los Angeles County, California.
